  • iQcom continually monitors the evolving privacy regulatory and legislative landscape to identify changes and determine what tools our customers might need to meet their compliance needs depending upon their applications. We recommend that customers and IQPN Partners with questions regarding iQcom and data protection regulations contact their iQcom account manager first. iQcom is not in the position to provide legal advice and we recommend that customers consult their legal counsel if they have legal questions.
  • Maintaining customer trust is an ongoing commitment. We strive to inform you of the privacy and data security policies, practices, and technologies we’ve put in place. These commitments include:
  • Access: As a customer, you maintain full control of your content and responsibility for configuring access to iQcom services and resources. We provide an advanced set of access, encryption, and logging features to help you do this effectively. We do not access or use your content for any purpose without your consent. We never use your content or derive information from it for marketing or advertising.

  • Storage: AWS (Amazon Web Services) is the only storage partner to iQcom. We will not move or replicate your content outside of our chosen AWS Region(s) without your consent, except as legally required and as necessary to maintain the AWS services.

  • Security: We offer you strong encryption for your content in transit and at rest. These features include:

    • Data encryption capabilities available in AWS storage and database services, such as Amazon Elastic Block Store, Amazon Simple Storage Service, Amazon Relational Database Service, and Amazon Redshift.

  • Disclosure of customer content: We do not disclose customer information unless we’re required to do so to comply with a legally valid and binding order. Unless prohibited from doing so or there is clear indication of illegal conduct in connection with the use of iQcom products or services, iQcom notifies customers before disclosing content information.

  • Security Assurance: We employs a security assurance program that uses best practices for global privacy and data protection to help you operate securely within AWS, and to make the best use of our security control environment.

how does iQcom classify customer data?

iQcom classifies customer data into two categories: customer content and account information.

We define customer content as software (including machine images), data, text, audio, video, or images that a customer or any end user transfers to us for processing, storage, or hosting by iQcom (through AWS services) in connection with that customer’s account, and any computational results that a customer or any end user derives from the foregoing through their use of iQcom services. For example, customer content includes content that a customer or any end user maintains in iQcom (stores in Amazon Simple Storage Service (S3)). Customer content does not include account information, which we describe below.

We define account information as information about a customer that a customer provides to us in connection with the creation or administration of a customer account. For example, account information includes names, usernames, phone numbers, email addresses, and billing information associated with a customer account. The information practices described in the iQcom Privacy Notice apply to account information.

who owns customer content?

As a customer, you maintain ownership of your content.. We do not use your content for any purpose without your consent. We never use customer content or derive information from it for marketing or advertising.

what about my account information?

The iQcom Privacy Notice describes how we collect and use account information. We know that you care how account information is used, and we appreciate your trust that we will do so carefully and sensibly.

what happens if iQcom receives a legal request for customer information?

We are vigilant about our customers’ privacy. We do not disclose customer content unless we’re required to do so to comply with the law, or with a valid and binding order of a governmental or regulatory body. Governmental and regulatory bodies need to follow the applicable legal process to obtain valid and binding orders. We review all orders and object to overbroad or otherwise inappropriate ones. Unless prohibited from doing so or there is clear indication of illegal conduct in connection with the use of iQcom products or services, iQcom notifies customers before disclosing customer content so they can seek protection from disclosure.

where is customer content stored?

AWS will be opening a data centre in South Africa during 2020 and as such this data centre will be the preferred data centre of iQcom’s South African client data.

AWS datacentres are built in clusters in various AWS Regions around the globe. Based on your geographic requirements, iQcom in partnership with AWS ensure the data storage in a data centre or centres that will best support the user experience offered by iQcom Offerings.

what steps does iQcom take to protect my data?

iQcom through our relationship with AWS complies with ISO 27018, a code of practice that focuses on protection of personal data in the cloud. It is based on ISO information security standard 27002 and provides implementation guidance about ISO 27002 controls that is applicable to personally identifiable information (PII) processed by public cloud service providers.

When evaluating the security of a cloud solution, it is important for you to understand and distinguish between the security of the cloud, and your security in the cloud. Security of the cloud encompasses the security measures that iQcom in partnership with AWS implements and operates. We are responsible for security of the cloud. Security in the cloud encompasses the security measures that you implement and operate, related to the IQ services you use. You are responsible for your security in the cloud.

How We Share Personal Information

Information about our customers is an important part of our business and we are not in the business of selling our customers’ personal information to others. We share personal information only as described below and with subsidiaries that Indisa (Pty)Ltd controls that are either subject to this Privacy Notice or follow practices at least as protective as those described in this Privacy Notice.

  • Transactions Involving Third Parties: We make available to you services, software, and content provided by third parties for use on or through iQcom Offerings. You can tell when a third party is involved in your transactions, and we share information related to those transactions with that third party. For example, you can process payments through the iQcom Offerings and we provide those service providers with relevant information to facilitate your transaction.

  • Third-Party Service Providers: We employ other companies and individuals to perform functions on our behalf. Examples include: sending communications, processing payments, assessing credit and compliance risks, analysing data, providing marketing and sales assistance (including advertising and event management), conducting customer relationship management, and providing training.   • Business Transfers: As we continue to develop our business, we might sell or buy businesses or services. In such transactions, personal information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Notice (unless, of course, the individual consents otherwise). Also, in the unlikely event that Indisa (Pty) Ltd or substantially all of its assets are acquired, your information will of course be one of the transferred assets.

Depending on the scope of your interactions with iQcom Offerings, your personal information may be stored in or accessed from multiple countries. Whenever we transfer personal information to other jurisdictions, we will ensure that the information is transferred in accordance with this Privacy Notice and as permitted by applicable data protection laws.

How We Secure Information

At Indisa (Pty)Ltd, security is our highest priority. We design our systems with your security and privacy in mind.

  • We maintain a wide variety of compliance programs that validate our security controls.

  • We protect the security of your information during transmission to or from iQcom websites, applications, products, or services by using encryption protocols and software.

  • We follow the Payment Card Industry Data Security Standard (PCI DSS) when handling credit card data.

  • We maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of personal information. Our security procedures mean that we may request proof of identity before we disclose personal information to you.

Internet Advertising and Third Parties

iQcom Offerings may include third-party advertising and links to other websites and applications. Third party advertising partners may collect information about you when you interact with their content, advertising, or services.

Access and Choice

You can view, update, and delete certain information about your account and your interactions with iQcom Offerings. If you cannot access or update your information yourself, you can always contact us for assistance.

You have choices about the collection and use of your personal information. Many iQcom Offerings include settings that provide you with options as to how your information is being used. You can choose not to provide certain information, but then you might not be able to take advantage of certain iQcom Offerings.

  • Account Information: If you want to add, update, or delete information related to your account, please go to the iQcom set-up. When you update or delete any information, we usually keep a copy of the prior version for our records.

  • Communications: If you do not want to receive promotional messages from us, please do not subscribe to any of our social media feeds. Communication relating to the business processes enabled by iQcom will be forwarded to you as it will be part of the core functionality of the solution. It will be in the form of in-app notifications, emails and/or SMS’s from us on behalf of your Body Corporate, Trustees and or Homeowners Association.

  • Browser and Devices: The Help feature on most browsers and devices will tell you how to prevent your browser or device from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether.

  • Sellers and iQcom Partners: Sellers and iQcom Partner Network members can add, update, or delete information in the iQcom Marketplace and IQPN Partner Central, respectively.

Children’s Personal Information

We don’t provide iQcom Offerings for purchase or use by children. If you’re under 18, you may use iQcom Offerings only with the involvement of a parent or guardian.

Retention of Personal Information

We keep your personal information to enable your continued use of iQcom Offerings, for as long as it is required in order to fulfill the relevant purposes described in this Privacy Notice, as may be required by law (including for tax and accounting purposes), or as otherwise communicated to you. How long we retain specific personal information varies depending on the purpose for its use, and we will delete your personal information in accordance with applicable law.

  • email communication and notification settings; and

Payment Gateway Terms of Service

Indisa Technologies (Pty)Ltd integrates in its Products various Payment Gateways provided by Third Party Payment Gateway Companies or Banks. The usage of the Payment Gateway integrated with the Indisa Technologies (Pty)Ltd is subject to the following Payment Gateway Terms.

Definitions

“Indisa Technologies (Pty)Ltd “, “We” represent the “Service Provider” and are interchangeable. It also represents any subsidiary company of Indisa Technologies (Pty)Ltd

“Products” imply all offerings of Indisa Technologies (Pty)Ltd, that are SaaS (Software as a Service) Products including but not limited to the Portals: iqcom.com, iqcom.co.za, iqcom.net and the Mobile Apps: iQcom.

“Association”, “Society”, “Resident Community” and “Body Corporate” are used interchangeably. This Term can also be used to indicate Property Builder, Facility Management Company, or any organisation authorised by Payers to collect from them.

“iQPGI” shall mean iQcom Payment Gateway Integration, and will imply all screens on the Products of Indisa Technologies (Pty)Ltd where Online Payment functionality is made available.

“iQPGI User” means any person holding a Valid Credit Card/Debit card/Net Banking Account and who desires to pay the Association for the Services listed by the Association on the Products of Indisa Technologies (Pty)Ltd, and makes payment for the same over the Internet on any of the Indisa Technologies (Pty)Ltd Products using a Valid Credit Card/Debit Card/Electronic Funds Transfer (EFT) Account.

“Issuing Bank” in respect of a IQPGI User, means the bank which has issued the Valid Credit Card to the iQPGI User with which iQPGI User makes the payment.

“Service” exclusively means any service that the Association offers to provide / have provided to the iQPGI User, the payment for which is being made by the iQPGI User.

“Card Associations” shall mean and include Master Card, Visa, Diners, American Express etc. which authorizes and enables credit card transactions.

Indisa Technologies (Pty)Ltd integrates Payment Gateway in its Products, and makes it available for the collection of Dues by Associations subscribing to its Products on the Software as a Service model.

The iQPGI User utilises the iQPGI upon agreement with the below Terms. While the Terms apply to every iQPGI User, it is of utmost importance for the Association to understand and agree to these Terms before Activation of the iQPGI.

Payment Gateway Terms

1. Description of Service

Indisa Technologies (Pty)Ltd has integrated third-party Payment Gateway(s) which can be availed by Associations for collecting Dues from its Owners/Tenants/Vendors. For this utility, Indisa Technologies (Pty)Ltd plays the role of an Online Collection Agent for the Associations.

2. Covenants of the Association

  1. The Association shall ensure that all charges levied against the iQPGI User is valid and is meant to be collected using the “iQPGI”. It will also maintain relevant Documentations (e.g., By-Laws, Membership Details) to substantiate all charges levied against the iQPGI User.

  2. The Association shall not input Credit/Debit Card or EFT Data on the iQPGI themselves or by the staff, on behalf of the iQPGI User.

  3. Indisa Technologies (Pty)Ltd will not be a party to any Agreement between the Association and the iQPGI Users – whatsoever. All agreements will be between the Association and the iQPGI Users.

  4. The Association shall ensure that all licenses and registrations required by the Association are in full force and effect to enable the Association to collect relevant charges/taxes from the iQPGI User.

  5. The Association assures and guarantees to the Indisa Technologies (Pty)Ltd, the Card Associations, Acquiring Banks, Facility Providers that the Association shall comply with all rules, byelaws and standards set by the Card Associations, Acquiring Banks, the Facility Providers and further assures and guarantees that the following products and services shall not be sold to the iQPGI Users using the iQPGI):

  6. Adult goods and services which includes pornography and other sexually suggestive materials (including literature, imagery and other media); escort or prostitution services.

  7. Alcohol which includes Alcohol or alcoholic beverages such as beer, liquor, wine, or champagne .

  8. Body parts which includes organs or other body parts .

  9. Bulk marketing tools which includes email lists, software, or other products enabling unsolicited email messages (spam) .

  10. Cable descramblers and black boxes which includes devices intended to obtain cable and satellite signals for free .

  11. Child pornography which includes pornographic materials involving minors .

  12. Copyright unlocking devices which includes Mod chips or other devices designed to circumvent copyright protection.

  13. Copyrighted media which includes unauthorized copies of books, music, movies, and other licensed or protected materials.

  14. Copyrighted software which includes unauthorized copies of software, video games and other licensed or protected materials including OEM or bundled software.

  15. Counterfeit and unauthorized goods which includes replicas or imitations of designer goods; items without a celebrity endorsement that would normally require such an association; fake autographs, counterfeit stamps, and other potentially unauthorized goods.

  16. Drugs and drug paraphernalia which includes illegal drugs and drug accessories, including herbal drugs like salvia and magic mushrooms.

  17. Drug test circumvention aids which includes drug cleansing shakes, urine test additives, and related items.

  18. Endangered species which includes plants, animals or other organisms (including product derivatives) in danger of extinction.

  19. Gaming/gambling which includes lottery tickets, sports bets, memberships/ enrolment in online gambling sites, and related content.

  20. Government IDs or documents which includes fake IDs, passports, diplomas, and noble titles.

  21. Hacking and cracking materials which includes manuals, how-to guides, information, or equipment enabling illegal access to software, servers, websites, or other protected property.

  22. Illegal goods which includes materials, products, or information promoting illegal goods or enabling illegal acts.

  23. Miracle cures which includes unsubstantiated cures, remedies or other items marketed as quick health fixes.

  24. Offensive goods which include literature, products or other materials that: a) Defame or slander any person or groups of people based on race, ethnicity, national origin, religion, sex, or other factors b) Encourage or incite violent acts c) Promote intolerance or hatred.

  25. Offensive goods, crime which includes crime scene photos or items, such as personal belongings, associated with criminals.

  26. Prescription drugs or herbal drugs or any kind of online pharmacies which includes drugs or other products requiring a prescription by a licensed medical practitioner.

  27. Pyrotechnic devices and hazardous materials which includes fireworks and related goods; toxic, flammable, and radioactive materials and substances .

  28. Regulated goods which includes air bags; batteries containing mercury; Freon or similar substances/refrigerants; chemical/industrial solvents; government uniforms; car titles; license plates; police badges and law enforcement equipment; lock-picking devices; pesticides; postage meters; recalled items; slot machines; surveillance equipment; goods regulated by government or other agency specifications .

  29. Securities which includes stocks, bonds, or related financial products.

  30. Tobacco and cigarettes which includes cigarettes, cigars, chewing tobacco, and related products.

  31. Traffic devices which includes radar detectors jammers, license plate covers, traffic signal changers, and related products.

  32. Weapons which includes firearms, ammunition, knives, brass knuckles, gun parts, and other armaments.

  33. Wholesale currency which includes discounted currencies or currency exchanges.

  34. Live animals.

  35. Multi-Level Marketing collection fees.

  36. Matrix sites or sites using a matrix scheme approach.

  37. Work-at-home information.

  38. Drop-shipped merchandise.

  39. Any product or service which is not in compliance with all applicable laws and regulations whether federal, state, local or international including the laws of the Country where the Association belongs.

The Association further confirms, undertakes and assures Indisa Technologies (Pty)Ltd, the Card Associations, the Acquiring banks and the facility providers that in the event of violation of any of the By-laws and Standards of the Card Associations, Acquiring Banks, Facility Providers and Indisa Technologies (Pty)Ltd by the Association and any penalty imposed by the Card Associations, Acquiring Banks, Facility Providers on Indisa Technologies (Pty)Ltd for any violation for any reason whatsoever, the Association shall on receipt of the claim from Indisa Technologies (Pty)Ltd undertakes forthwith without any demur, protest, dispute or delay, to pay to Indisa Technologies (Pty)Ltd the amount of the penalty / fine imposed by the Card Associations, Acquiring Banks, Facility Providers on Indisa Technologies (Pty)Ltd

3. Disputes Regarding Services

Indisa Technologies (Pty)Ltd, the facility providers and the Acquiring Banks shall not be responsible for the quality of Services to the IQPGI User. (Services imply those provided by Association to the IQPGI User. Please refer to Definitions for details). Indisa Technologies (Pty)Ltd, the facility providers and the Acquiring Banks shall also not be responsible for any non-delivery of the Services to the IQPGI User. Provided that any and all disputes regarding quality, non-delivery and delay in delivery of the Service or otherwise will be dealt with by and between the Association and the IQPGI User directly and Indisa Technologies (Pty)Ltd, the facility providers and the Acquiring Banks shall not be a party to such disputes.

4. Indemnity

Indisa Technologies (Pty)Ltd, the facility providers and the Acquiring Banks shall not be responsible for the quality of Services to the IQPGI User. (Services imply those provided by Association to the IQPGI User. Please refer to Definitions for details). Indisa Technologies (Pty)Ltd, the facility providers and the Acquiring Banks shall also not be responsible for any non-delivery of the Services to the IQPGI User. Provided that any and all disputes regarding quality, non-delivery and delay in delivery of the Service or otherwise will be dealt with by and between the Association and the IQPGI User directly and Indisa Technologies (Pty)Ltd, the facility providers and the Acquiring Banks shall not be a party to such disputes.

  • a) any breach or non-performance by the Association of any of the Association’s undertakings, warranties, covenants, declarations or obligations under this Agreement; or

  • b) any claim or proceeding brought by the IQPGI User or any other person against Indisa Technologies (Pty)Ltd, the Facility Providers and the Acquiring Banks in respect of any services offered by the Association; or

  • c) any act, neglect or default of the Association’s agents, employees, licensees or IQPGI Users; or

  • d) any loss or liability arising to Indisa Technologies (Pty)Ltd or the Acquiring Banks or the Facility Providers Banks in respect of any services offered by the Association; or

  • e) any claim by any other party against Indisa Technologies (Pty)Ltd, the Facility Providers and the Acquiring Banks arising from sub-clause (a), (b),(c) or (d) above.

Example of specific situations could result in a charge back claim.

a) The IQPGI User moves out of the Residential Complex, the Move-Out fee is levied on the IQPGI User. The IQPGI User makes payment using his credit card, and later claims to the Credit Card
company, claiming it to be an incorrect Payment. In this situation, the responsibility rests with the Association to have adequate documentation, to prove that the IQPGI User was a Member of the Association, as well as By-Laws that substantiate charging of the Move-Out Fee. In absence of such substantiations, or upon non-acceptance of any such substantiation by the Acquiring Bank, Credit Card company or Card Associations, any resulting charge back (cancellation of the payment by the credit card) has to be refunded by the Association.

b) The IQPGI User uses a stolen Credit Card to make a Payment. The Credit Card company will later cancel all these payments, which must promptly be refunded by the Association.

(2) The indemnities under this Article are in addition to and without prejudice to the indemnities given elsewhere in this Payment Gateway Terms and all the indemnities provided herein shall survive the termination of the Subscription Agreement

5. No Warranty

(1) Indisa Technologies (Pty)Ltd, the Acquiring Banks and the Facility Providers disclaims all warranties, express or implied, written or oral, including but not limited to warranties of merchantability and fitness for a particular purpose. The Association acknowledges that the Indisa Technologies (Pty)Ltd, the Facility Providers and the Acquiring Bank’s services may not be uninterrupted or error free. The Association also acknowledges that the services provided by the Acquiring banks and the facility providers to Indisa Technologies (Pty)Ltd which is passed on to the Association under the IQPGI agreement, can be in any event be brought to an abrupt end in any event whatsoever by any of the acquiring banks or the facility providers for any reason whatsoever.

(2) Indisa Technologies (Pty)Ltd sole obligation and the Association’s sole and exclusive remedy in the event of interruption to the Services or loss of use and/or access to the Products of Indisa Technologies (Pty)Ltd, the facility Providers facilities and the Acquiring Bank’s Payment Mechanism and services, shall be to use all reasonable endeavors to restore the Services and/or access to the Payment Mechanism as soon as reasonably possible.


Without prejudice to any other provision of this Agreement, Indisa Technologies (Pty)Ltd, the Facility Providers and the Acquiring Banks does not warrant that: –

a. The Products of Indisa Technologies (Pty)Ltd, the facility providers facilities and the Acquiring Bank’s Payment Mechanism will be provided uninterrupted or free from errors or that any identified defect will be corrected; or

b. is free from any virus or other malicious, destructive or corrupting code, program or macro; or


(3) For the avoidance of doubt, in no event shall Indisa Technologies (Pty)Ltd, the Facility Providers and the Acquiring Banks be liable to the Association or any other third party for any of the following: a. amounts due from IQPGI User in connection with any service obtained by the IQPGI User from the Association;

a. any applicable taxes and Government levies;

6. Transaction Limits

Indisa Technologies (Pty)Ltd, the Facility Providers and the Acquiring Banks reserves the right to impose limits on the number of purchases which may be charged on an individual credit card account during any time period, and reserves the right to refuse to make payments in respect of transactions exceeding such limit or from IQPGI Users with a prior history of questionable charges.

7. Termination

a) Termination for Breach.

Indisa Technologies (Pty)Ltd may terminate the IQPGI Agreement with prior written notice to the Association of at least 30 days if the Association commits any breach of the terms of this Agreement.

b) Termination in Case of Violation of Law.

In addition to any other termination rights granted by this Terms of Service, Indisa Technologies (Pty)Ltd may terminate the Agreement immediately without liability upon verbal or written notice if
(i) Indisa Technologies (Pty)Ltd or the Facility Providers or the Acquiring Banks is notified or otherwise determines in good faith that the Association is using the IQPGI in furtherance of any activity which violates any law, rule, or regulation or

(ii) Indisa Technologies (Pty)Ltd, the Acquiring Banks or the Facility Providers or any of their directors, officers, stockholders, employees or agents are made the subject of a criminal or civil action or investigation or are threatened by such action as a consequence of use of the IQPGI by the Association.

c) Termination by notice

In addition to any other termination rights granted under this Terms of Service, either Party may terminate this Agreement on 30 days written notice to the other.

Indisa Technologies (Pty)Ltd provides its service to you, subject to the following Terms of Service (“TOS”), which may be updated by us from time to time with information to you.

Overview

The below terms of service are applicable to all Users of the iQcom Portals: iQcom.co.za, iQcom.com, iQcom.net and the Mobile Apps: iQcom.

This website is operated by Indisa Technologies (Pty)Ltd. Throughout the site, the terms “we”, “us” and “our” refer to Indisa Technologies. Indisa Technologies offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Definitions

“Indisa Technologies”, “We” represent the “Service Provider” and are interchangeable. It also represents any subsidiary company of Indisa Technologies (Pty)Ltd.

“Products” imply all offerings of Indisa Technologies, that are SaaS (Software as a Service) Products including but not limited to the iQcom Portals: iqcom.co.za, iqcom.com, iqcom.net and the Mobile Apps: iQcom.

“You” addresses the individual User reading and agreeing to these Terms.

“LOCOM” (local community) means the specific community belonging to a specific Apartment Complex” or “Multi Dwelling Complex” can mean a Villa Complex or an Apartment Complex, a Residential Estate or a Commercial Complex. It can also imply any such Organisation of Users utilising the Products.

“Association”, “Society”, “Body Corporate” are used interchangeably.

“iQcom” and “iQcom app” are used interchangeably to imply the Product that automates Workflows in Communication, Facility Management, Billing, Collection and Accounting.

“iQcom” is a product of Indisa Technologies (Pty)Ltd. Indisa Technologies (Pty)Ltd plays the role of a custodian for the information stored by the User via either of these Products on Servers maintained by Indisa Technologies (Pty)Ltd.

The following paragraphs contain further information about our Terms of Service, Privacy Policy, Payment Gateway Terms. Please make sure you read through this carefully. Please proceed with the use of the Products upon agreement with the Terms.

1. Description of Service

Indisa Technologies (Pty)Ltd provides a suite of Products categorised as below.

  • a) The “iQcom ERP” which provides Central Database of the Multi Dwelling Unit, integrated with Tools for Communication, Facility Management, Visitors Management, Billing and Accounting.

  • b) The “iQcom app” which is used by each Resident of the Multi Dwelling Unit, and is a Companion App/Portal to above product. These two products are integrated with each other. Depending on the access available to you, you may use any of these Products. Up-to-Date information on the Service Offerings are found on the website.

2. Indisa Technologies (Pty)Ltd Private Policy

Personal information about you are subject to our PRIVACY POLICY which is a section in these Terms.

3. User Account, Password and Security

You are responsible for maintaining the confidentiality of the User ID and password you choose when you create your account, and are fully responsible for all activities that occur under your account. You agree to immediately notify Indisa Technologies (Pty)Ltd of any unauthorised use of your password. Indisa Technologies (Pty)Ltd will not be liable for any consequence arising from your failure to comply with this Section.

4. Abuse of Service

You understand that all information (such as data files, written text, audio files, images or any other media) which you may have access to as part of, or through your use of the products of Indisa Technologies (Pty)Ltd are the sole responsibility of the person from which such content originated. Indisa Technologies (Pty)Ltd takes no responsibility for abusive content, and it is the responsibility of the users to regulate such content. Indisa Technologies (Pty)Ltd takes no responsibility for any data generated within any of its products and published or distributed outside by the user.

In using the product iQcom the Association and Administrative Users take responsibility to treat the Visitor Data with same Privacy and Sanctity that they do for Visitor Data captured prior to use of the iQcom products. Indisa Technologies (Pty)Ltd takes no responsibility for any data captured in iQcom and published or distributed outside by any User having access to such data.

Indisa Technologies (Pty)Ltd reserves the right to suspend its service to Users involving in service abuse.

5. List of prohibited products

Users are prohibited from aiding in the sale / exchange of any item present in the below list. This is only a partial list and items can be added as and when prohibited to law or brought to the notice of Indisa Technologies (Pty)Ltd.

Airline tickets that restrict transfer, other unauthorized ticket sale – Alcohol or tobacco products – Blood, bodily fluids or parts – Bulk email or mailing lists that contain names, addresses, phone numbers, or other personal identifying info Burglary tools, including but not limited to lock-picks or motor vehicle keys – Controlled substances or illegal drugs, substances and items used to manufacture controlled substances and drug paraphernalia -Counterfeit currency, coins and stamps, tickets, as well as equipment designed to make them – Counterfeit, replica, or knock-off brand name goods – Coupons or gift cards that restrict transfer, other unauthorized coupons or gift cards – False identification cards, forged certificates – Fireworks, firearms and explosives – Gambling items, including but not limited to lottery tickets – Material that infringes copyright, including but not limited to software or other unauthorized digital goods sale – Pornography – Pet animal parts, blood, or fluids – Prescription drugs and medical devices, including but not limited to prescription or contact lenses, defibrillators, hypodermic needles or hearing aids – Stolen property, or property with serial number removed or altered.

Items can be included in the above list as and when prohibited.

6. No resale of service

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Products, use of the Products, or access to the Products.

7. Modification of service

As SaaS products, all of Indisa Technologies (Pty)Ltd offerings will undergo continuous modifications in its Features and Service. In case any feature or service is phased out, adequate time and notice will be given to you, so that you may retain the Information assets created by you as part of that Feature. Beyond the time given, you agree that Indisa Technologies (Pty)Ltd shall not be liable to you or to any third party.

8. Indisa Technologies (Pty)Ltd proprietary rights

You acknowledge and agree that the Products contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorized by Indisa Technologies (Pty)Ltd, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Products, in whole or in part. You also agree not to extract the code or reverse-engineer it in anyway. Any attempt at hacking or unlawful use of the Products can and will invite the maximum prosecution allowable under the law.

9. Warranties and Disclaimers

We warrant that:

  • The Products shall perform materially in accordance with the Functionality listed in Features List, and

  • The functionality of the Products will not be materially decreased during a subscription term. A Subscription Term is defined by the term for which the Subscription Payment is already made. For any breach of either such warranty, your exclusive remedy shall be Termination of Use including Refund of Advance Payments made for the Subscription Term.

10. Limitation of liability

In no event shall either party’s aggregate liability arising out of or related to these Terms/Agreement, whether in contract, tort or under any other theory of liability, exceed the total amount paid by you under the current active Subscription Term.

In specific Indisa Technologies (Pty)Ltd is not liable to respond to queries from third parties about a Multi Dwelling Unit’s use of the Product. All queries must come from the officially designated Users of the Multi Dwelling Unit itself.

By using this Product, you confirm that you have the legal authority of uploading and sharing the specific data that You would upload or share on this Product. You indemnify Indisa Technologies (Pty)Ltd of any disputes regarding the ownership of such data.

11. Support SLA

  • a) All Support queries are to be lodged using the “Software Help” feature present on the Products. If the issue is related to log in, support email can be sent to support@iqcom.co.za

  • b) All support queries will receive initial response within maximum 16 business hours of Indisa Technologies (Pty)Ltd receiving the request. Business hours are 8AM to 5PM. (GMT+2). Support SLAs are available to all Users covered by a Subscription Term. Support SLAs are not available to Users on Trial, or any other Unpaid Usage mode.

12. Exit of Subscription

This agreement is subject to review by either party at any time during the Subscription Term. If either party requires terminating this agreement, 30 days notice must be given and the data will be available for the customer to be extracted during this period. The notice period must be within the subscription paid duration.

After such 30-day period, The Indisa Technologies (Pty)Ltd shall have no obligation to maintain or provide any of the Customer’s Data and shall thereafter, unless legally prohibited, delete all of Customer’s Data in the Service Provider’s systems or otherwise in its possession or under its control.

Privacy Policy

Indisa Technologies (Pty)Ltd. does not sell, rent or otherwise make available the personal information of the Users, Visitors, Association Staff, Domestic Staff or the common information of the Multi Dwelling Unit to any third-party, without their explicit approval. (Please refer to the applicable Privacy Policy)

Registration

To use the Products, a user must first complete the registration form. During registration, a user is required to give their contact information and proof of being associated with the Multi Dwelling Unit. The registration information given by the user must always be accurate, correct and up to date. This ensures the User can get the maximum benefit from the Product.

Your Personal Information

The User stores information about himself/herself under his/her User Profile. Information provided is available to the User and the Administrative Users belonging to the same Multi Dwelling Complex as the user. The Visitor information entered in iQcom is available to the Unit to which the Visitor is visiting, and to the Administrative Users belonging to the same Multi Dwelling Complex as the user. The Domestic Staff information entered in iQcom is available to the unit in which the specific Domestic Staff member works and to the Administrative Users belonging to the specific Multi Dwelling Complex. The Vendor information entered is available to the Administrative Users belonging to the specific Multi Dwelling Complex. Administrative Users may also enter Personal Information of the Users. Indisa Technologies (Pty)Ltd. takes no responsibility for the accuracy of such data entered by the Users or Administrative Users.

These Personal Information are retained for the period covered by the Subscription Term, unless the Administrative Users choose to delete the Personal Information.

Links to other sites may be present in the Products. Please be aware that we are not responsible for the privacy practices of such other sites. Please be aware when you leave the Product site and visit these other sites, to read the privacy statements of such sites especially in case they collect personally identifiable information. This privacy policy applies solely to information collected by the Products of Indisa Technologies (Pty)Ltd.

Mobile Apps

The Mobile Apps of the Product may seek access to data stores in your Mobile Phone, such as SMS, Photos, Contact List etc. The purpose of this access is solely towards complete functionality of relevant Product Features. The Mobile Apps will not run to their full potential if you choose to not provide the necessary access.

Classifieds

The Classifieds is a feature provided for Users for availing useful services for their Home or Multi Dwelling Complex . The User understands that any information provided by the User on Classifieds, is visible outside his LOCOM. The User is responsible for any information they share via Classifieds.

Security

Indisa Technologies (Pty)Ltd. takes every precaution to protect users’ information. When users submit sensitive information via the portal, the information is protected both online and off-line. We have enabled SSL encryption so as to ensure that your data remains encrypted during transmission to and from the site. These precautions, though industry standard are nonetheless only as secure as the end-user’s practice. To ensure that unauthorised parties do not get access to information on this portal, we encourage all users make sure that they log-off from all sessions – especially from public computers such as at internet cafes.

As part of our disaster recovery strategy, we have daily backups taken to protect you from sudden data loss. If you have any questions about the security at our portal, you can send an email to support@iqcom.co.za.

Site and Service Updates

We also send the user site and service announcement updates. Users may choose to unsubscribe from receiving these emails by following the instructions that will be part of each announcement email.

Notification of Changes

Any change made to the Privacy Policy will be posted on the Homepage so our users are always kept aware. They will also be notified via Email about any such change.

Notification to Visitors

While Users belong to the legal entity of an Association and may receive important notifications on their Mobile Number, Visitors are not part of the Association. Notification to Visitor Mobile Numbers, if any, will be strictly as per the relevant LOCOM rules and regulation.

Privacy and security of Payment Information

Indisa Technologies (Pty)Ltd. makes it possible for the User to pay various charges via its Products. Details of securing the Payment Information is available in a separate Terms known as the “PAYMENT GATEWAY TERMS”
